.Berkeley School System Not Race-Based

A state appellate court has ruled that the Berkeley public school’s attempts to achieve racial integration do not violate California’s ban on affirmative action, according to today’s Chron. The district’s five-year-old policy attempts to put children from mostly rich white neighborhoods in the same schools with kids from low-income, minority ones. But because the district doesn’t take into account the race or economic background of any particular child when making school assignments, it’s not a race-based system, the court ruled. The conservative Pacific Legal Foundation, which filed the suit against the district in an attempt to outlaw the integration policy, is expected to appeal the ruling to the state Supreme Court.
