According to the Berkeley Daily Planet, the state Court of Appeals has refused to issue an order banning UC Berkeley from proceeding with construction of its new sports training center. California Oak Foundation lawyer Stephan Volker is due to appeal to the state Supreme Court this morning, but if the court also rejects his suit, it’s time for the chainsaws to start revving up. In the next few days, the police could well start dragging the last tree-sitters out of their perches, and the oak grove could finally be wiped out.
