1. The city of Oakland has had to spend nearly $1.4 million so far defending itself against a lawsuit filed by developer Phil Tagami, who wants to ship coal through the old Army base, the San Francisco Chronicle reports. And the case hasn’t even gone to trial yet — the trial begins tomorrow. Tagami sued Oakland after the council voted in 2016 to ban coal in the city.

2. The death toll from this year’s flu season continues to climb — 42 people under the age of 65 have now died from the virus, reports Julia Prodis Sulek of the Mercury News$. The flu epidemic has resulted in packed hospital emergency rooms throughout the state. In the Bay Area, 19 people under the age of 65 have died.

3. Twenty people have now been killed in the massive mudslides in the town of Montecito near Santa Barbara, the LA Times$ reports. At least four people are still missing. The mudslides were fueled by heavy rains drenching fire-scorched hillsides.

4. President Trump’s racists comments — referring to Haiti and African countries last week as “shitholes” — have likely derailed hopes of a bipartisan deal on DACA, the Washington Post$ reports. The DACA program provides a path to citizenship to young undocumented immigrants who came to this country as children.

5. And national parks are free today — on the Martin Luther King Jr. holiday, the Sacramento Bee$ reports.
